Private legal practitioner and member of the Ghana Bar Association (GBA), Justice Abdulai, has expressed his support for President John Dramani Mahama’s decision to suspend Chief Justice Gertrude Torkornoo. He asserts that the action is constitutionally justified and follows proper legal procedures.

His remarks come in response to a resolution passed by the GBA, which labeled the suspension as unconstitutional and lacking legal basis under the 1992 Constitution, urging for its immediate revocation.

Speaking on The Big Issue on Channel One TV on Saturday, May 3, Justice Abdulai rejected the GBA’s stance and questioned its legal foundation. “I completely disagree with the resolution and every single letter in the resolution that was passed,” he stated.

Justice Abdulai argued that the president and the Council of State acted within the law, considering all relevant responses, including that of the Chief Justice.

“The response of the CJ is not ordinarily supposed to form part of the basis for determining whether or not a prima facie case has been made. However, in this particular case, given that these advances were made and accepted by the president, it indicates that the Council of State and the president took the CJ’s response into account and determined that a prima facie case has indeed been established,” he explained.
